BEST OF THE BEST PLC - STANDARD COMPETITION TERMS

  1. Qualifying Persons: Our Competitions - skill based games resulting in the allocation of prizes - (the ‘Competition(s)’) are open to all persons aged 16 and over except Best of the Best Plc's (the 'Promoter') employees or members of their immediate family, agents or any other person who is connected with the creation or administration of our Competitions.
  2. Legal Undertaking: By entering a Competition the Entrant (‘Entrant’) will be deemed to have read and understood these rules and to be bound by them and by any other requirements set out in any related promotional material. Competitions are governed by English Law and any matters relating to the Competition will be resolved under English Law and the Courts of England shall have exclusive jurisdiction. In the event of playing a Competition online, by accepting these terms and conditions you confirm that you are not breaching any laws in your country of residence regarding the legality of entering our Competitions. The Promoter will not be held responsible for any Entrant entering any of our Competitions unlawfully. If in any doubt you should immediately leave the website and check with the relevant authorities in your country.
  3. Competition Entry: Competitions may be entered at our airport sites or online. Availability and pricing of Competitions is at the discretion of the Promoter:
    • a) To enter a Competition at the airport, you will need to purchase Competition entries ('Tickets') through a member of staff at a stand operated by the Promoter. Using all the information shown in the sporting photograph displayed on the computer screen (from which the original ball has been permanently erased), use your skill and judgement to correctly identify the grid square within which you consider the Judge will decide, is the most likely position of the centre of the ball. Click on the screen to mark this spot (you can see your spot's coordinates on the screen). The computer will register this spot as your entry into the Competition. You may repeat this process for as many entries as you wish to make. Then you will provide the operator on the stand with your contact details and the appropriate payment. You will be emailed a receipt with your personal details and Ticket entries.
    • b) When playing a Competition online or at an airport self-service kiosk, follow the on-screen instructions and play the Competition as outlined in (3a). When you are ready to purchase your Ticket(s), follow the on-screen instructions to provide your contact details and your credit card details. You will need to check your details carefully and tick the declaration, confirming you have read and understood the Competition rules. When your credit card payment has cleared we will then contact you by email to confirm your entry into the Competition (in the case of Instant Win Competitions, we will also provide you with instantaneous feedback). Please note that when entering online you will not be deemed entered into the Competition until we confirm your Ticket order back to you by email.
  4. Gift Vouchers: To pay for your Ticket(s) using a Gift Voucher, please follow the playing instructions outlined in (3b). To make payment, enter the code supplied on your Gift Voucher at the checkout stage. Your entry into the Competition will be confirmed when the Gift Voucher code is authorised. Please note that Competition entries can only be purchased up to and including the value of the Gift Voucher. No refund for the Gift Voucher will be provided by the Promoter. If you wish to purchase Tickets that have a greater value than that of the Gift Voucher, it is possible to pay for the remainder on your credit card. Please note, if you are using a Gift Voucher as payment when playing the Competition online, you will not be deemed entered into the Competition until we confirm your Ticket order back to you by email.
  5. Competition Judgement
      • a) Time Limited Supercar Competitions: Time Limited Supercar Competitions will close on the date specified. The position of the centre of the ball will normally be determined after the close of the competition by an independent Judge (a sporting expert appointed by the Promoter – the 'Judge') using his sporting experience and in the presence of a qualified lawyer and a representative from the Promoter. In certain cases and at the discretion of the Promoter, the position of the centre of the ball may be determined before the Competition starts, and will immediately be encrypted and stored securely on our database. The Judge's chosen position will then be computed against the database of coordinates to mathematically calculate which of the Competition Entrants is closest to the Judge's position, and therefore the winning Entrant (the 'Winner') of the prize. The Winner will be the person who correctly identifies, or if no one is correct, who is closest to, the grid square within which the centre of the ball is judged to be located.

        In the event that one or more Entrants are equally close to or exactly match the Judges' coordinates (a 'Tie') when a Time Limited Competition (Competition reference prefixed with 'SC') is judged, these Entrants (the 'Competition Tie Entrants') will be asked to take part in another “spot the ball” Competition in order to determine a single Winner. The Tie entry mechanism (the 'Competition Tie Break') will be exactly the same as before but with a new sporting photograph and there will be no payment due. The Competition will be judged in exactly the same way to determine the Winner. In the very unlikely event there is another Tie, the Competition Tie Break process will be repeated until there is a single Winner.

        In the event of a Time Limited Supercar Competition Tie Break (Competition reference prefixed with 'SC'), the Cash Alternative (see below 7a) for the Competition will be split between the Supercar Competition Tie Entrants as detailed below. The Winner of the Supercar Competition Tie Break will receive 60% of the Cash Alternative specified for the category of prize they have entered (i.e. 60% x £100,000 = £60,000 for Supercar Category 1; 60% x £55,000 = £33,000 for Supercar Category 2, and 60% x £30,000 = £18,000 for Supercar Category 3). The Supercar Competition Tie Entrant(s) involved in the Supercar Competition Tie Break who do not win will share in equal percentages the remaining 40% of the Cash Alternative specified, for the category of prize they have entered.

        By way of example, in a Time Limited Supercar Competition Tie Break involving two Entrants (Entrant A with a Ticket from Supercar Category 1 and Entrant B with a Ticket from Supercar Category 2), where the Winner of the Supercar Competition Tie Break was Entrant A, the Cash Alternative prizes payable would be £60,000 to Entrant A and £22,000 to Entrant B (i.e. 60% x £100,000 = £60,000 for Supercar Category 1 Tie Entrant A, and 40% x £55,000 = £22,000 for Supercar Category 2 Tie Entrant B).

        By way of further example, in the very unlikely event of a Time Limited Supercar Competition Tie Break involving five Entrants (Entrants A, B with Tickets from the Supercar Category 1; Entrants C and D with Tickets from Supercar Category 2; and Entrant E with a Ticket from Supercar Category 3), where the Winner of the Supercar Competition Tie Break was Entrant A, the Cash Alternative prizes payable would be as follows: £60,000 to Entrant A, £10,000 to Entrant B; £5,500 to Entrants C and D and £3,000 to Entrant E (i.e. 60% x £100,000 = £60,000 for Supercar Category 1 Tie Entrant A; 40%/4 x £100,000 = £10,000 for Supercar Category 1 Tie Entrant B; 40%/4 x £55,000 = £5,500 for Supercar Category 2 Tie Entrants C and D; and 40%/4 x £30,000 = £3,000 for Supercar Category 3 Tie Entrants E).

        The Promoter will attempt to contact Competition Winners using the telephone numbers and email address provided at the time of purchase (or as subsequently updated) and held securely in our database. It is the Competition Entrants sole responsibility to check and update these details. If for any reason they are taken down incorrectly the company will not be held responsible. If for any reason we are unable to contact a Competition Winner within 15 days (which may be extended at the sole discretion of the Promoter) of the end of a Competition, the Competition Winner will forfeit the prize (or right to participate in a Tie Break process if applicable) and it will be awarded to the Entrant with the next closest coordinates, as defined in the judging process. For the avoidance of doubt once the prize has been forfeited the original Competition Winner will have no further claims against the Promoter. It is the responsibility of Competition Entrant’s to ensure and check in their account that the contact details provided to us and held securely in our database are correct and up to date, and the Promoter will not be liable for any losses arising as a result of incorrect details being held in its database, howsoever arising.

      • b) Other Time Limited Competitions (e.g Watch, Gadgets, Handbag, Daily): Time Limited Competitions will close on the date specified. The position of the centre of the ball will normally be determined after the close of the competition by an independent Judge (a sporting expert appointed by the Promoter – the 'Judge') using his sporting experience and in the presence of a qualified lawyer and a representative from the Promoter. In certain cases and at the discretion of the Promoter, the position of the centre of the ball may be determined before the Competition starts, and will immediately be encrypted and stored securely on our database. The Judge's chosen position will then be computed against the database of coordinates to mathematically calculate which of the Competition Entrants is closest to the Judge's position, and therefore the winning Entrant (the 'Winner') of the prize. The Winner will be the person who correctly identifies, or if no one is correct, who is closest to, the grid square within which the centre of the ball is judged to be located. In the event that one or more Entrants are equally close to or exactly match the Judges' coordinates (a 'Tie') when a Time Limited Competition is judged, these Entrants ('Joint Winners') will split the specified cash alternative (£2,750 for the Watch Competition, £550 for the Handbag Competition and £1,750 for the Gadget Competition) equally between them.

        The Promoter reserves the right to cancel any Time Limited Competition, for any reason, before the designated closing date. In these circumstances the Promoter reserves the right to transfer the Entrants' Ticket(s) into another Competition for which the ticket price is at least the same or more than the original price paid. The Promoter also reserves the right at its sole discretion to extend the closing date on any Time Limited Competition.

      • c) Instant Win Competitions: Instant Win Competitions will close immediately when an entrant matches the Judges' coordinates or, if no one matches the Judges' coordinates, on the specified end date (‘Drop Dead Date’). The position of the centre of the ball will be determined before the Competition starts by an independent Judge, using his sporting experience in the presence of a qualified lawyer and a representative from the Promoter, and will immediately be encrypted and stored securely on our database. Each Competition entry will be computed against the Judge's coordinates. If the coordinates match, the Winner is selected instantaneously and the Competition closes.

        If no one has exactly matched the chosen coordinates prior to the specified Competition Drop Dead Date then the Winner will be awarded either a specified amount of Game Credit or the actual prize (please refer to the individual competition details). The Judges' chosen position will be computed against the database of all the entrants' coordinates to mathematically calculate which of the competitors is closest to the Judge's position, and therefore the Winner of the Game Credit or Prize. In the event of a Tie, the winning entrants ('Joint Winners') will share equally the specified Game Credit or Cash Alternative (please refer to the individual competition details).

        All pre-purchased Instant Win Credits must be played prior to the closing of the relevant competition. For the avoidance of doubt, if an Instant Win Competition closes and there is un-played Instant Win Credit in an entrants’ account for that competition, it will be forfeited.

    • d) Free Competitions: Free Competitions will close on the date specified. The position of the centre of the ball will be determined after the close of the competition by a Director from the Promoter. The chosen position will then be computed against the database of coordinates to mathematically calculate which of the Competition Entrants is closest to this position, and therefore the winning Entrant (the 'Winner') of the prize. The Winner will be the person who correctly identifies, or if no one is correct, who is closest to, the grid square within which the centre of the ball is judged to be located. In the event of a Tie, the winning Entrants ('Joint Winners') will share equally the specified Cash Alternative.
    The Winner of a Competition will be notified at the address or telephone number given in their contact details within 20 days of the closing date of the relevant Competition. Any Entrant may check the results of Competitions completed within the last 12 months at our website www.botb.com. All decisions of the Judge will be final and binding on the Entrants and no correspondence will be entered into.

    The Promoter will attempt to contact Competition Winners using the telephone numbers and email address provided at the time of purchase (or as subsequently updated) and held securely in our database. If for any reason we are unable to contact a Competition Winner within 30 days (which may be extended at the sole discretion of the Promoter) of the end of a Competition, the Competition Winner will forfeit the prize (or right to participate in a Tie Break process if applicable), and it will be awarded to the Entrant with the next closest coordinates, as defined in the judging process. For the avoidance of doubt once the prize has been forfeited the original Competition Winner will have no further claims against the Promoter.

    All Competition Entrants are automatically entered onto the Promoter's database for the purpose of conveying information as to the status of their Competition, as well as for any future promotions or Competitions offered by the Promoter.
  6. Winner's Details: The Winner will be required to send a copy of their passport to the Promoter to confirm their identity, age and also to prove that if the purchase was made by credit card that the card was legally theirs or that they had authorisation to use it, before any prize will be paid or delivered. The Winner will also be required to provide photographs for use in future marketing by the Promoter. Following receipt and verification of the details requested above by the Promoter, the Winner will be contacted in order to make arrangements for delivery of the prize. At this point the Winner must choose between the prizes available (as detailed in the Competition prize information on the Promoters' website www.botb.com) and notify the promoter of their choice in writing.
  7. Competition Prizes:
    • a) Time Limited Supercar Competitions:Time Limited Supercar Competitions are comprised of three categories: Supercar Category 1 Tickets (‘Supercar Category 1’); Supercar Category 2 Tickets (‘Supercar Category 2’); and Supercar Category 3 Tickets (‘Supercar Category 3’). The Winner of a Time Limited Supercar Competition (a Competition reference prefixed with 'SC') will be able to choose one prize from the list of prizes pertaining to the Category of Ticket they have purchased, as detailed on the website/airport kiosk relating to that Competition. For the avoidance of doubt, there will be only one prize awarded for each Time Limited Supercar Competition and not one prize from each of Supercar Category 1, Supercar Category 2 and Supercar Category 3. Please also note the following:
      • (i) During the course of a Time Limited Supercar Competition the Promoter reserves the right to add or remove prizes from the Competition but there will always be a selection of Left and Right Hand Drive cars.
      • (ii) The cars owned and displayed by the Promoter consist of both registered and unregistered vehicles. Please note also that some of the cars exhibited at our airport sites are for display purposes only and cannot be taken as prizes (the reason for this is that some of these cars have excess delivery mileage or may not be VAT qualifying).
      • (iii) If the Winner would like to take a car that the Promoter does not already own, an order will be placed by the Promoter. Please note that if the Winner decides to do this, delivery may take up to 12 months for certain cars and cars will be ordered in basic specification. All cars whether left or right hand drive will be ordered in the UK from UK dealers only. Bespoke options and upgrades can be added at the prize Winners' request but must be paid for in advance. The winner can choose the car in Left or Right Hand Drive (subject to manufacturer availability and terms and conditions).
      • (iv) In the UK the prize will be delivered with UK VAT paid. In the EU the prize will be delivered with UK VAT paid but any further costs (VAT/taxes/import duties/registration costs due in the destination/country of final registration) will be the responsibility of the prize Winner.
      • (v) In all other countries the prize will be shipped (net of all taxes) to the nearest port and any applicable import duties/taxes/registration costs due in the destination country will be the responsibility of the prize Winner. The promoter reserves the right not to deliver to certain countries. Please note that all our cars are supplied in the UK and therefore if exported may not be road legal in the destination country. It is the winner’s responsibility to check this and choose an alternative car or take the cash alternative if appropriate.
      • (vi) For Entrants at the Promoters' Copenhagen Airport site we offer certain cars with Danish registration taxes paid ('Danish Tax Paid') – please see the airport kiosk for details. Please note that the Danish Tax Paid option is strictly limited to certain cars and that if a Danish National prize Winner wishes to choose any other car, they will be liable for applicable Danish Taxes.
      • (vii) The promoter will pay for the servicing and insurance for the first year of car ownership. Invoices for servicing and insurance will need to be supplied to the Promoter before any money will be credited and the prize Winner must own the car for a full 12 months from date of delivery. The maximum the promoter will pay for insurance is £10,000 and if the insurance quote exceeds this amount the winner will have to pay the additional fees. Insurance will be subject to a £5,000 excess, be for normal road use only, limited to 20,000 miles and will be subject to the terms and conditions of the insurance provider. Servicing will be undertaken by a main dealer and be subject to “normal road use only”. The maximum the promoter will pay for servicing costs is £4,000. These maximum limits will apply even if a two car bundle is chosen.
      • (viii) Supercar Competition Cash Alternative: Should a Supercar Competition (prefixed ‘SC’) Winner not wish to take delivery of one of the prizes detailed, the Supercar Competition Cash Alternative can be claimed. The Cash Alternative is £100,000 for the tickets purchased in Supercar Category 1; £55,000 for tickets purchased in Supercar Category 2; and £30,000 for Tickets purchased in Supercar Category 3. Please note that the additional money offered towards insurance and servicing costs for the first year of supercar ownership is not included should the Winner opt for the Supercar Competition Cash Alternative.
      • (ix) Runners Up Prizes: Runners Up Prizes will be awarded for Supercar Competitions only, in the following manner. The ten Entrants closest to the Judge's position with the exception of the Winner, will each receive £200 worth (face value) of Supercar Competition tickets for Competitions run by the promoter. These may not be used in conjunction with any further offers and must be redeemed within 6 months.
    • b) Other Time Limited Competitions and Instant Win Competitions: The Winner of a Competition (excluding Supercar Competitions (prefixed ‘SC’) detailed in 7a above) will simply be able to choose (if applicable) one of the prizes or the Cash Alternative as specified and detailed on the Promoter's website www.botb.com, relating to that Competition.
      In the European Union and the UK the prize will be delivered with UK VAT paid but any other taxes/import duties/registration costs due will be the responsibility of the prize Winner. In all other countries the prize will be shipped (net of all taxes) and any applicable import duties/taxes/registration costs due in the destination country will be the responsibility of the prize Winner. The promoter reserves the right not to deliver to certain countries.
    • Storage: The Promoter will store the chosen prize free of charge for 30 days after notifying the Winner, at the end of which time the prize will be delivered to the Winner.
    • Winners' Personal Data: Acceptance of the prize by the Winner gives the Promoter the right to use the prize-Winner's name, personal photograph and home country for promotional purposes, both immediately after their win and in the future, unless prohibited by law.
    • Limits of Liability: The Promoter makes no representations or warranties as to the quality/suitability of any of the goods or services offered as prizes. Except for liability for death or personal injury caused by the negligence of the Promoter, the Promoter shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods by any person to the prize Winner and, where applicable, to any family/persons accompanying the Winner, or in connection with any of the Competitions promoted by the Promoter.
    • Electronic Communications: No responsibility will be accepted for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet, accessibility or availability or for traffic congestion or unauthorised human act.

      The Promoter shall use its best endeavours to award the prize for a competition to the correct Entrant. If due to reasons of hardware, software or other computer related failure, or due to human error the prize is awarded incorrectly, the Promoter reserves the right to reclaim the Competition prize and award it to the correct Entrant, at its sole discretion and without admission of liability. The Promoter shall not be liable for any economic or other consequential loss suffered or sustained to any persons to whom an award has been incorrectly made, and no compensation shall be due.
    • Data Protection Notice: Any personal data that you supply to the Promoter or authorise the Promoter to obtain from a third party, for example, a credit card company, will be used by the Promoter (i) to administer the Competition; and (ii) (unless you tell us that you prefer not to receive direct marketing) to contact you about other Competitions or about other goods and services which the Promoter considers may be of interest to you.

      In order to process, record and use your personal data the Promoter may disclose it to (i) any credit card company whose name you give; (ii) any organisation (whether or not connected to the Promoter) for the purpose of bringing to your attention goods and services which the Promoter considers may be of interest to you; (iii) any person to whom the Promoter proposes to transfer any of the Promoter's rights and/or responsibilities under any agreement the Promoter may have with you; (iv) any person to whom the Promoter proposes to transfer its business or any part of it; (v) comply with any legal or regulatory requirement of the Promoter in any country; and (vi) prevent, detect or prosecute fraud and other crime.

      In order to process, use, record and disclose your personal data the Promoter may need to transfer such information outside the United Kingdom, in which event the Promoter is responsible for ensuring that your personal data continues to be adequately protected during the course of such transfer.
